What Is a TN Visa?

The TN visa is an employment-based nonimmigrant classification established under NAFTA and now governed by the USMCA. It’s available only to citizens of Canada and Mexico. Unlike H-1B visas, TN status has no annual cap and no lottery. If you meet the requirements, you can apply. Approvals aren’t limited by the calendar year.

TN status is initially granted for up to three years and can be extended in three-year increments as long as eligibility continues. One important constraint: because TN is a nonimmigrant classification, applicants must demonstrate nonimmigrant intent and plans to return home after their authorized stay. Pursuing permanent residency while holding TN status requires careful planning.

TN Visa Eligibility Requirements

Three conditions determine whether someone qualifies for TN status.

Qualifying Profession
The position must fall within the USMCA’s designated list of professional categories, which covers engineering, computer science, accounting, law, medicine, scientific disciplines, and education, among others. If your occupation isn’t on the list, TN status isn’t available for that role.

Academic Credentials or Licensure
You must hold the educational qualifications or professional licenses required for the occupation, typically a bachelor’s degree or higher in a directly related field. Some professions require specific licenses.

Prearranged Employer Job Offer
A U.S. employer must have offered you a position that requires professional-level qualifications. Self-employment doesn’t qualify. The offer can be full-time or part-time, but it must be documented and specific about your role and duties.

These are two sectors that regularly hire Canadian and Mexican workers under TN status. I represent TN visa clients across the DFW area, from initial applications through renewals and status changes.

One thing worth knowing before you apply: the process differs significantly depending on whether you’re a Canadian or Mexican citizen. The steps, the agencies involved, and the documents required aren’t the same. Understanding your path before you begin can save time and help avoid preventable delays.

How to Apply: Canadian vs. Mexican Citizens

The application process divides along citizenship lines, and the difference is substantial.

Canadian Citizens

Canadian citizens don’t need to apply for a TN visa at a U.S. consulate. Instead, they apply for TN status directly at a U.S. port of entry or a designated pre-clearance station. A U.S. Customs and Border Protection (CBP) officer reviews the application on the spot and may grant TN status at the time of entry.

To apply at the port of entry, a Canadian applicant must present proof of Canadian citizenship, an employer support letter describing the job offer, duties, anticipated length of stay, and the applicable TN profession category, and supporting credentials such as degrees, professional licenses, and experience documentation.

Mexican Citizens

Mexican citizens must obtain a TN visa at a U.S. consulate before entering the United States to work. The process involves completing Form DS-160 (the standard nonimmigrant visa application) online, scheduling and attending a consular interview, and submitting a valid passport, employer support letter, and supporting documents. Once approved, the TN visa is stamped in the passport, and the applicant may enter the U.S. and begin employment.

A third path exists in certain circumstances: a U.S. employer may file Form I-129 (Petition for Nonimmigrant Worker) with USCIS on behalf of an applicant who is already in the United States and seeking a change of status to TN.

TD Status for TN Visa Dependents

Spouses and unmarried children under 21 of a TN holder may accompany or join them in the United States under TD nonimmigrant status. TD status allows dependents to reside and attend school at any level for the same duration as the TN holder’s authorized stay.

One important limitation: TD status doesn’t include work authorization for spouses. If a spouse wishes to work in the U.S., a separate employment-based classification is required.

The application path for dependents follows the same citizenship split as the principal applicant. Canadian family members may apply for TD status at the port of entry alongside the TN holder. Mexican family members must apply for a TD visa at a U.S. consulate, which involves completing visa application forms, attending an interview, and providing proof of the relationship and evidence of the TN holder’s status. If the TN status expires or isn’t renewed, TD status ends at the same time.

Staying in Compliance After TN Approval

TN status ties you to a specific employer and a specific role. A change of employer requires a new TN application. It is filed through USCIS if you’re already in the United States, or at a port of entry or U.S. consulate if applying from abroad. A material change in job duties with the same employer may also trigger a new filing requirement, even if your title doesn’t change.

Because TN status requires nonimmigrant intent, taking steps toward permanent residency can complicate future TN renewals or reentry. This is an area where my background as both an attorney and a CPA is directly relevant: the employment and financial decisions that feel separate from your immigration status often aren’t. Changes in worksite location, including shifts to remote work, may also require additional documentation. Working outside the approved scope or without proper authorization can result in status revocation and affect future visa eligibility.
